Terms of Service
Last updated: 5 October 2026
These Terms of Service (“Terms”) govern your access to and use of Prompteryx — the website at prompteryx.ai, our applications, Prompteryx Desktop, the Prompteryx Chrome extension, APIs and related services (together, the “Service”). The Service is provided by PROMPTERYX LIMITED (“Prompteryx”, “we”, “us”); our details are in section 21. By creating an account or using the Service you agree to these Terms, including our Acceptable Use Policy. If you do not agree, do not use the Service.
Consumers and business users. You are a “consumer” if you use the Service as an individual wholly or mainly for purposes outside your trade, business, craft or profession. Otherwise — including if you use the Service for or on behalf of a company or other organisation — you are a “business user”, and if you accept these Terms for an organisation you confirm that you are authorised to bind it, and “you” includes that organisation. Some sections apply differently to consumers and business users; where they do, the section says so. If you are a consumer, nothing in these Terms takes away the rights the law gives you that cannot be excluded.
1. What Prompteryx is
Prompteryx is a browser-automation and AI-agent platform. Depending on your plan, the Service includes:
- AI Browser Agent — an AI agent that operates a web browser to carry out tasks you describe, either in cloud browsers we host or on your own computer through Prompteryx Desktop and our Chrome extension.
- Visual Studio — a no-code visual builder for creating, running and scheduling browser and integration workflows.
- AI chat workspace — a conversational workspace that can research, generate documents, images, video, audio, websites and apps, and run automations on your behalf.
- Personal agent — where available, an assistant that can prepare briefs from accounts you connect, watch pages for changes and carry out errands you approve.
- Batch Prompter — tooling for running prompts in bulk across AI platforms.
- Schedules and automations — the ability to run workflows automatically on a timetable or trigger.
- Connect Hub — integrations with around 3,000 third-party applications, provided through our integration partner.
- Sharing and publishing — Showcase (Explore) posts, published web pages and websites, and apps you build and publish.
- Developer platform — a public REST API and SDK for building on Prompteryx programmatically.
We are continuously improving the Service and may add, change or remove features, as section 9.2 describes.
2. Eligibility and accounts
You must be at least 18 years old to use the Service, and you confirm this when you create your account. We delete accounts that we find belong to someone under 18. When you create an account you agree to:
- provide accurate, complete registration information and keep it up to date;
- keep your password, API keys and other credentials confidential;
- notify us promptly at contact@prompteryx.ai if you suspect unauthorised access; and
- accept responsibility for all activity that happens under your account, including automations you configure to run unattended.
You must not create an account if you are, or act for, a person who is the target of sanctions imposed by the United Kingdom, the United Nations, the European Union or the United States, or if you are located in a country or region subject to comprehensive sanctions (see section 3.5). Accounts are personal: one person per account, and you may not share your sign-in or create accounts to get round limits, suspensions or charges.
We use automated checks to stop abuse at sign-up and payment (for example disposable e-mail addresses, unusual sign-up patterns and card fraud screening by our payment provider). If you think a check has blocked you wrongly, contact us and a person will review it.
3. Acceptable use
Prompteryx gives you powerful automation. You are responsible for how you use it.
3.1 Prohibited conduct
You agree that you will not use the Service to:
- Break the law — engage in any activity that is unlawful in your jurisdiction or the jurisdiction of the websites and services you automate.
- Violate third-party terms — access or automate a website or service in a way that breaches its terms of service or acceptable-use rules.
- Defeat access controls — use any feature (including our proxy and CAPTCHA features) to get round authentication, paywalls, rate limits or other protections on a site in order to abuse it or to reach anything you are not authorised to access.
- Scrape personal data unlawfully — collect, harvest or process personal data without a lawful basis, or in violation of applicable data-protection law (including UK/EU GDPR).
- Abuse other people’s accounts — automate actions on an account or system you do not own or lack explicit authority to operate.
- Send spam or commit fraud — send unsolicited bulk messages, run phishing flows, manipulate metrics (fake clicks, reviews, votes), or engage in any deceptive practice.
- Cause harm — distribute malware, mount denial-of-service attacks, probe or attack the security of the Service or any third party, or harass or threaten others.
- Infringe rights — violate intellectual-property, privacy or publicity rights.
- Resell without permission — resell, sublicense or white-label the Service except under a written agreement with us.
3.2 Prohibited content
You must not use the Service — including AI features, automations, Showcase, published pages and websites, apps you publish, file links and shared workflows — to create, store, share, publish or distribute:
- child sexual abuse material or any content that sexualises children, including drawn, animated or AI-generated material, or anything intended to groom or sexually exploit a child;
- terrorist content, including content that encourages, glorifies or assists terrorism or supports a proscribed organisation;
- threats (including threats to kill or seriously harm), harassment, stalking or intimidation;
- content that stirs up racial or religious hatred or hatred on the grounds of sexual orientation, or that is otherwise a hate offence;
- fraud and financial crime, including scams, phishing pages, fake log-in pages, fake shops, unauthorised financial promotions, money laundering, and impersonating a person or organisation to deceive;
- offers to sell or supply illegal drugs, psychoactive substances, firearms, knives or other weapons where that is unlawful, or to assist illegal immigration or human trafficking;
- content that facilitates sexual exploitation, including controlling or causing prostitution for gain, or extreme pornography;
- sexually explicit or pornographic content of any kind on any part of Prompteryx that other people can see (published pages, websites, apps, Showcase posts, comments and profiles), even if it would be legal elsewhere;
- intimate images of a person shared, or threatened to be shared, without their consent (including sexually explicit “deepfakes”), and unsolicited sexual images;
- content showing a real, identifiable person — or using their name, face or voice — in a sexual, degrading, defamatory or deceptive way, or to harass, threaten or impersonate them;
- realistic images, audio or video of a real person (“deepfakes”) that show them doing or saying something they did not, unless that person has agreed and the content is clearly labelled as AI-generated or manipulated — and never sexual deepfakes, deepfakes of children, or deepfakes meant to mislead people about news, elections or public affairs;
- realistic depictions of real children, other than with the consent of their parent or guardian and never in a sexualised, degrading or harmful way;
- content that encourages or assists suicide or serious self-harm;
- content that is part of foreign interference in political or public life;
- content that infringes copyright, trade marks or other intellectual-property rights;
- malware, or tools and workflows designed to compromise accounts or systems;
- other people’s personal data without a lawful basis, including “doxxing” (publishing someone’s home address, contact details or other identifying information to expose or target them);
- spam, or manipulation of likes, views, rankings, votes or reviews;
- AI-generated content used to mislead; or
- anything else that is unlawful under the law that applies to you or to us.
3.3 Acceptable Use Policy
Our Acceptable Use Policy explains sections 3.1 and 3.2 in more detail and forms part of these Terms.
We may investigate suspected violations and act as described in section 5.6, including suspending or terminating accounts that breach this section, without refund of consumed credits. Where automation of a third-party site is involved, you — not Prompteryx — are responsible for making sure you have the right to automate it.
3.4 AI model providers’ rules
The AI models in the Service are provided by third parties (listed in our Privacy Policy, section 6). When you use a model, you must also follow that provider’s usage rules — for example Anthropic’s Usage Policy, OpenAI’s Usage Policies and Google’s Generative AI Prohibited Use Policy — including their bans on developing weapons capable of mass casualties, attacking critical infrastructure, and using a model’s output to develop a competing AI model where the provider prohibits it. A model may refuse a request, and we may block a request or an account that a provider tells us breaks its rules.
3.5 Sanctions and export control
You must comply with the sanctions and export-control laws that apply to you and to us (including those of the United Kingdom, the European Union and the United States). You must not use the Service: if you are, or are owned or controlled by, a sanctioned person; from, or for the benefit of anyone in, a country or region subject to comprehensive sanctions; or to send, export or provide access to anything in breach of those laws. We may refuse, suspend or end access, and block payments, where we reasonably believe that continuing would break those laws or expose us to sanctions risk; where the law allows, we refund unused prepaid amounts.
4. Your content and workflows
You own the workflows, prompts, documents, files, recordings, web pages, apps and other content you create, upload, share or publish using the Service (“Your Content”), to the extent you hold rights in it. We claim no ownership of it.
You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, make technical copies of (for example caches, backups and format conversions), process, transmit, display, execute and distribute Your Content, only as needed to: (a) provide, operate, secure and support the Service for you; (b) show or deliver Your Content to the people you choose, in the way you choose — for example when you share a workflow with a named person, send someone a file link, or publish a page, an app or a Showcase post; and (c) review, label, moderate, restrict or remove it in line with these Terms and the law. Our service providers (listed in our Privacy Policy) may do these things on our behalf. This licence ends when Your Content is deleted from the Service, except for copies we must keep for legal reasons, copies already shared or published as you directed (see section 5.8), and backups that expire on their normal schedule.
Your Content is private by default. It becomes visible to others only if you choose to share or publish it — including to people who do not have a Prompteryx account, for example when you publish a web page at an unlisted or public link. Section 5 sets out the additional licences and rules that apply to content you share or publish.
You are responsible for Your Content and for what you share or publish — including having the rights to any data your workflows collect or process, for what your automations do with it, and for any data that a scheduled workflow adds to a page you have published.
No training on Your Content. We do not use Your Content to train AI models, and we choose AI providers whose terms do not allow them to train on it — except a provider you choose after we have told you otherwise and asked for your explicit consent (section 6). We may use anonymised, aggregated information about how the Service is used (for example which features are used and how often), which does not identify you or reveal Your Content, to run, secure and improve the Service.
Keep your own copies. We keep backups to protect the Service, but the Service is not an archive. Chats, run history, recordings and downloads are deleted automatically at the end of your plan’s retention period (Privacy Policy, section 8). Export or keep copies of anything you cannot afford to lose.
Personal data you process with the Service. If you are a business user and use the Service to process personal data about other people (for example your customers, contacts or the people your automations deal with), you are the controller of that data and we process it for you as your processor under our Data Processing Agreement, which forms part of these Terms. If you are a consumer using the Service for purely personal or household purposes, data-protection law treats your own use differently, but you must still respect other people’s rights.
5. Sharing, publishing and community content
5.0 What this section covers
This section applies to everything you make available to other people through the Service (“Shared Content”), including:
- Showcase (Explore) posts and comments, and your public profile (sections 5.1–5.3 and 5.7 apply only to Showcase);
- web pages and websites you publish at a prompteryx.ai/p/ address, and apps you publish (section 5.11);
- links to files you share (for example generated images and documents); and
- workflows you share with other people, and any connection you allow them to use.
Published pages can be private (only you can open them), unlisted (anyone with the link can open them; we do not list them and we ask search engines not to index them) or public (anyone can open them, and search engines may index them). Nobody needs a Prompteryx account to open an unlisted or public page. Anyone you give a link to can pass it on. You can reset an unlisted link, which stops the old link working, or set it to expire. Before you share a page we ask you to confirm a short sharing statement, and we record that you did.
The CC BY 4.0 licence in section 5.3 applies only to public Showcase posts. It does not apply to published pages, apps, file links or shared workflows: for those, you grant only the licence in section 4.
5.1 What publishing to Showcase means
Showcase is the community area of the Service where users can publish their creations — for example workflows, AI Browser Agent tasks, documents, slides, images, animations, web pages and prompts — as posts that other people can view, like, comment on, remix and copy. Nothing you create is published unless you publish it yourself, one item at a time. When you publish, we create a separate copy (a “snapshot”) of the item: the title, description, the recipe (such as the prompt, model and settings) and a preview. Later edits to your original do not change the snapshot.
- Public posts appear in Showcase and on your public profile, can be found by anyone who can access Showcase, and are licensed to everyone under CC BY 4.0 (section 5.3).
- Unlisted posts are not listed in Showcase or search, but anyone with the link can view them and remix them within the Service. Anyone you give the link to can pass it on.
- You may publish under your public handle or anonymously. An anonymous post shows “Prompteryx user” instead of your handle, but it remains linked to your account so that you can manage it and so that we can act on reports. Your email address is never shown.
- AI Browser Agent tasks are published as the task prompt and an outcome summary only. Browser screenshots and session recordings are never published.
5.2 Review before you publish
Before a Showcase post goes live we automatically remove content that looks like secrets or personal data (such as passwords, API keys, tokens, email addresses and phone numbers) and run an automated review. Before a page or website is shared we check it for passwords, keys and other secrets and for imitations of other organisations’ sign-in or payment pages, and refuse to share it if it fails — but we do not remove personal data from pages: they are published as you wrote them. These safeguards reduce risk but cannot catch everything. You must check what you share and only share it if it contains nothing you are not entitled to make public. We may hold a post for human review before it goes live.
5.3 Licences for published content
- Public posts. By publishing a post publicly you license its content to everyone under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). This means anyone, on or off the Service, may copy, adapt and reuse it, including commercially, provided they give appropriate attribution. The CC BY 4.0 licence cannot be revoked for copies already made, even if you later unpublish the post.
- Unlisted posts. You permit people who have the link to view the post and to remix or copy it within the Service. No wider licence is granted.
- Licence to Prompteryx. For every post (public or unlisted) and every comment, you also grant Prompteryx a worldwide, non-exclusive, royalty-free licence to host, store, make technical copies of, display, distribute, format, create previews and thumbnails of, label, moderate, restrict and remove it, as needed to operate Showcase. For public posts only, this licence also lets us feature the post within the Service and on our website, credited to your handle (or to “Prompteryx user” if you posted anonymously). We do not feature unlisted posts or comments anywhere other than where you posted them. This licence ends when the post or comment is removed, except for copies we must keep for legal reasons and backups that expire on their normal schedule.
- You keep ownership of your content. These licences do not transfer ownership to anyone.
5.4 Your responsibility for what you share
You are responsible for everything you share or publish, including comments. You confirm that:
- you own the content or have all the rights needed to share it and to grant the licences in sections 4 and 5.3;
- it contains no personal data about anyone else (names, contact details, account details, customer records, messages or similar) unless you have a lawful basis and their permission to make it public;
- it contains no passwords, API keys, tokens, webhook URLs or other secrets, and no confidential information of your employer, clients or anyone else; and
- it complies with these Terms, including section 3 and the Acceptable Use Policy.
5.5 Content and conduct rules
You must not use Showcase, published pages, apps or any other Shared Content to share or promote anything section 3 prohibits (including the content listed in section 3.2). In addition, even where it would otherwise be lawful, you must not share or publish:
- personal data of other people, or credentials and other secrets;
- sexual or sexually explicit content (and never any content that sexualises children — see section 3.2);
- hate speech, harassment, threats, bullying or content that promotes violence;
- malware, or workflows designed to compromise accounts (for example credential stuffing, password lists, login loops or intercepting one-time passcodes);
- automations designed to evade a website’s protections in order to abuse it (for example rate-limit evasion or creating fake or bulk accounts) or that breach a named website’s terms;
- content that infringes copyright, trade marks or other rights, including media you do not have the rights to share;
- deceptive content, including phishing pages, impersonation of people or organisations, and scams;
- spam, manipulation of likes, views or rankings, or repetitive or misleading posts; or
- anything else that is unlawful or that section 3 prohibits.
Comments must be relevant and respectful. Rate limits apply to publishing, commenting, liking and reporting. Do not publish a page or app that imitates another organisation’s website or sign-in page, or that collects passwords or payment details.
5.6 Moderation, reporting and takedown
We moderate Shared Content using automated tools — including automatic removal of secrets and personal data from Showcase posts, automated classifiers (our “Jev” decision model and, where used, AI model providers), checks for imitation sign-in pages and secrets on pages and apps, and automatically hiding content that has been reported while we review it — together with human review by our team. We may refuse, hide, label, restrict (for example make unlisted or reset a link), quarantine or remove any Shared Content, remove a staff pick or ranking, and suspend or remove your ability to publish, share or comment, where we reasonably believe content breaches these Terms, the law or the rights of others, or creates risk for users or for us. We apply these rules carefully, objectively and proportionately. We do not review all content before it is shared, and, except where the law says otherwise, we are not responsible for content that other users share or publish.
How to report. Every unlisted or public item — Showcase posts and comments, published pages, websites and apps, and public profiles — has a Report link, and anyone can paste a link at prompteryx.ai/report. Anyone can use it, including people who do not have a Prompteryx account. You can also email contact@prompteryx.ai with the subject “Report”. Reporting is free.
What to include. So that we can act quickly, a report should include:
- the exact link (URL) of the content, and anything else we need to find it;
- why you believe it is illegal or breaks these Terms — for illegal content, which law you think it breaks, if you know;
- your name and email address — but you can report child sexual abuse material without giving them, and we will review any report without them, although we will not then be able to update you; and
- a statement that you believe in good faith that the information in your report is accurate and complete.
For copyright and other intellectual-property complaints, please also identify the work or right concerned, confirm that you are the rights holder or authorised to act for them, and use the subject line “Copyright/takedown”.
What happens next. If you give us an email address, we will confirm receipt without undue delay. We review reports promptly, carefully and objectively, dealing with the most serious harms first. We may use automated tools to help, and if a decision on your report was made by automated means we will tell you. We may hide content while we review it. We will tell you our decision and how you can challenge it.
If we act on your content. If we remove, disable access to, hide, label, demote or restrict your content, or suspend or restrict your account or your ability to publish, share or comment, we will send you a statement of reasons no later than when the restriction takes effect, unless we have no way to contact you. The statement will say: what we did, where it applies and for how long; the facts we relied on, including whether we acted on a report or on our own initiative (we will not identify the person who reported you unless that is strictly necessary); whether automated tools were used to detect the content or to make the decision; the law, or the part of these Terms, we relied on, and why we think the content breaks it; and how you can challenge the decision.
Appeals and counter-notices. If you disagree with a decision — whether you made the report or posted the content — you can appeal within six months using the Appeal button on our notice, or by emailing contact@prompteryx.ai with the subject “Appeal”. A person will review the appeal (where possible, someone who was not involved in the original decision), tell you the result and the reasons, and promptly reverse the decision if we got it wrong. A counter-notice to a copyright or other intellectual-property removal is handled as an appeal. We may share a notice or counter-notice with the other party, without your contact details unless you agree. Using this process does not affect your right to go to court or any other rights you have under the law.
Serious illegal content. If we become aware of child sexual abuse material, terrorist content, or content that shows a threat to someone’s life or safety, we will remove it straight away, may suspend or close the account at once without warning, and may keep the content and related account information to give to the authorities. We may report it to the National Crime Agency, the Internet Watch Foundation, Counter Terrorism Policing, the police or other competent authorities in the UK or elsewhere (including the US National Center for Missing & Exploited Children). Where we suspect that a criminal offence threatening someone’s life or safety has been, is being or is likely to be committed, we will tell the relevant law-enforcement authorities.
Repeat infringers and repeat offenders. We deal with repeated breaches of section 3 or section 5.5 (including repeated infringement of other people’s rights) in steps. Usually that means: (1) removing the content and warning you; (2) temporarily suspending your ability to publish, share or comment; and (3) permanently removing that ability or closing your account. We take into account how serious, how frequent and how recent the breaches were, and whether they were deliberate. For serious breaches — including anything involving child sexual abuse material, terrorism, fraud or threats to safety — we may skip steps and close your account immediately. After a warning, we may also stop processing, for a reasonable period, reports or appeals from anyone who frequently sends ones that are clearly unfounded.
5.7 Remixes and attribution
A remix or copy made from a post is a new item in the account of the person who made it. Where a remix is shown in Showcase we display a link to the original post and its author (unless the original was anonymous). If you remix someone else’s public post and share the result outside the Service, you must give attribution as CC BY 4.0 requires. Remixing does not give you any rights in the original author’s account, connections or data.
5.8 Unpublishing and account deletion
- You can unpublish any post, or make all your posts private at once from Settings → Sharing & privacy, at any time. Either way the published snapshot, preview and thumbnails are deleted within minutes, and comments on the post are hidden immediately and deleted after 30 days. Switching a single post to Private instead of unpublishing it hides it from everyone but you straight away and keeps your own copy so you can publish it again later.
- You can stop sharing or delete a published page, website or app at any time; its link stops working straight away.
- Remixes and copies that other people made before you unpublished stay in their accounts, and copies made under CC BY 4.0 may continue to exist elsewhere. After you unpublish, remixes no longer link to you or your post.
- If you delete your account, all your posts are unpublished and deleted as above, your published pages, websites and apps are deleted, your public profile is deleted, and your comments on other people’s posts remain but are shown as written by “[deleted user]”. You can delete comments individually before deleting your account if you do not want them to remain.
- An account-level “share by default” setting, if you turn it on, only pre-selects the option to publish new items; it never publishes anything you created earlier, and you still confirm each post.
5.9 How we moderate content
This section explains, in plain terms, the rules, tools and people involved when we restrict what you share.
- Before you share: we check web pages, websites and apps for imitations of other companies’ sign-in or payment pages and for passwords, API keys and similar secrets, and we refuse to publish anything that fails those checks. Showcase posts also go through automatic redaction of personal details and an automated review that can hold a post for a person to look at.
- After you share: anyone can report an item. Reports are read by a person. Several reports — or one report of personal data or secrets from an established account — can hide a Showcase post or comment automatically until a person reviews it.
- Our own review: we may look at shared content when we have reason to think it breaks the law or these Terms.
What we can do. Depending on how serious the problem is, we may: remove or hide an item; stop a link working; refuse to publish; restrict features such as publishing; suspend or close an account; and report content to the authorities where the law requires it. We act in a way that is diligent, objective and proportionate, and we take into account the rights and legitimate interests of everyone involved, including freedom of expression.
Automated tools. We use automated tools to detect phishing pages, secrets and personal details, to score Showcase posts and comments, and to hide content temporarily after reports. Automated tools never make a final decision to remove your content or close your account on their own; a person does.
5.10 Complaints and appeals
You can complain to us if: (a) you think content on Prompteryx is illegal or breaks these Terms; (b) we removed, hid or restricted your content, or limited or closed your account, and you think we got it wrong; (c) you think we did not act on a report you made; or (d) you think we are not meeting our duties under the UK Online Safety Act 2023.
How. For (b), press Appeal on the notice we sent you (or email contact@prompteryx.ai with the subject “Appeal”) within six months of the decision. For the others, use the Report link or email us. You do not need an account.
What happens next. We will acknowledge your complaint, a person who can reverse the decision will review it, and we aim to reply within 14 days. If we agree with you, we restore your content (or, if it can no longer be restored, tell you that you may share it again) and say so. If we do not, we explain why.
Other options. You may also be able to take the matter to court. If you are in the EU you may be able to use a certified out-of-court dispute settlement body. Ofcom does not decide individual complaints, but you can tell Ofcom about problems with how an online service handles safety.
5.11 Apps you build and publish
If you use the App builder, the App Builder Terms also apply and you accept them before you first use it. In short: you are responsible for your app and for the people who use it; you are the controller of your app users’ personal data and we process it for you as your processor; and your published app must follow the published-app rules in those terms, which let us take an app down when it breaks the law or these Terms.
6. AI features
AI output can be wrong. Large language models generate content probabilistically: results may be inaccurate, incomplete or unsuitable for your purpose, and an AI agent may take an action you did not intend. You must review AI output — and supervise automations that take consequential or irreversible actions (payments, deletions, messages sent to real people) — before relying on them. The same applies to AI-generated content that other people share: if you view a page, post, app or file someone made with Prompteryx, check it before relying on it.
You are responsible for the instructions you give the AI Browser Agent, the personal agent and other AI features, and for the actions they take on your behalf. AI output is provided for your use; to the extent we hold any rights in it, we assign them to you. AI features must not be used to generate unlawful content or to do anything section 3 prohibits.
- Not professional advice. AI output is not legal, medical, financial, tax, safety or other professional advice. Do not use it as the only basis for decisions where an error could cause harm — get advice from a qualified person.
- Not for high-risk uses. Do not use the Service to operate or control anything where a failure could lead to death, injury or serious damage (for example medical devices, vehicles or critical infrastructure), or for emergency services.
- Agents act within the permissions you give. When you let an agent act for you — on websites, in connected accounts, on your computer — you authorise it to take the steps needed to complete the task within the approval settings you choose. Use the “ask before” settings for anything consequential, and supervise it.
- Output may not be unique or protectable. Similar output may be generated for other people. AI-generated material may not be protected by copyright or other rights, and may resemble existing works; check it before you rely on rights in it or publish it commercially.
- Models change. AI providers update, replace and retire models, and their behaviour, quality and availability can change without notice to us. We may switch a feature to a different model of similar capability, and a model may refuse a request.
Transparency. Our chat and agents are AI systems and say so. Emails our assistants send to other people on your behalf state that they were written with AI. Images, video and audio we generate carry machine-readable “AI-generated” information, and shared items carry an “AI-generated” label.
Model choice. Some AI models are run by providers whose terms differ from our usual ones; where that matters we explain it and, if the law requires, ask for your explicit consent before your first request. Kimi models are served through OpenRouter by US and EU providers that keep no copy of your content and do not train on it, so no extra consent is needed. See the Privacy Policy, section 3.
AI-generated content you share. If you share or publish AI output, it is Your Content and you are responsible for it. Anyone who views it relies on it at their own risk. We label items made with our AI features as “AI-generated” (or similar), and we keep the provenance information that marks generated media as AI-generated. You must not remove or obscure such a label, metadata or watermark, or present AI-generated content as made by a person, where that would mislead people. Where the law requires it — for example under the EU AI Act when you publish realistic AI-generated or manipulated images, audio or video of real people, objects, places or events (a “deepfake”), or AI-generated text published to inform the public on matters of public interest — you must clearly disclose that the content is AI-generated or manipulated, unless it is obviously artistic, satirical or fictional and labelled in a way that does not spoil it.
7. Third-party services and connections
The Service lets you connect third-party accounts (for example Google, Microsoft, Slack or Airtable) and interact with third-party websites. Your use of those services remains governed by their own terms and policies. We access connected services only as you direct — to execute your workflows and automations — and you can disconnect them at any time. See our Privacy Policy for how we handle data from connected services.
We are not responsible for third-party services: their availability, their data, or changes they make that affect your automations (websites change their structure; automations that depended on the old structure may stop working). We are not a party to your relationship with a third-party site or service. If a third party limits, suspends or closes your account with it, or makes a claim against you, because of how you used an automation, that is between you and that third party.
8. Plans, credits and billing
8.1 Plans
The Service is offered on a free tier and paid monthly subscription plans (currently Starter, Builder, Developer and Pro, with custom Enterprise agreements). Current pricing and allowances are shown at prompteryx.ai/pricing. Payments are processed by Stripe; we do not store your full card details.
8.2 AI credits
AI usage is measured in credits, consumed as AI actions run (agent steps, AI workflow nodes, chat and generation features). The usage page shows what you have used.
- Plan credits are your plan’s allowance for each billing period. They reset at the start of each period; unused plan credits do not carry over.
- Credit packs you buy do not expire while your account is open, and are used after your plan credits.
- Credits have no cash value, cannot be transferred, sold or exchanged, and are not a deposit or e-money.
- If your account is closed because you broke these Terms, unused credits lapse. If we close your account for any other reason, or stop providing the Service, we refund unused credit packs you paid for, pro rata.
- If we discover we metered usage wrongly, we will correct it: we refund or re-credit any overcharge; we will not charge you retrospectively for an undercharge without telling you first.
8.3 Renewal, cancellation and refunds
- Subscriptions renew automatically each billing period until cancelled. You can cancel at any time in Settings → Subscription (“Cancel subscription”) or through the billing portal; cancellation takes effect at the end of the period you have paid for, and you can resume before then.
- We remind you before a renewal where the law requires it (for example before each annual renewal).
- 14-day withdrawal right. If you are a consumer in the UK or EU you may withdraw from a subscription or a purchase within 14 days, without giving a reason, using “Withdraw from contract” at prompteryx.ai/withdraw (or by emailing us). We confirm receipt by email and refund what is due within 14 days of your withdrawal, using your original payment method. Because you ask us to start straight away when you subscribe, the refund is reduced by a proportionate amount for the service supplied until you withdrew; for credits and top-ups, the right ends for anything you have already used.
- Otherwise, consumed credits are non-refundable and we do not provide refunds or credits for partial billing periods, except where required by law or these Terms say so (sections 8.2, 9.2, 13 and 17).
- Failed payments. If a payment fails we will tell you and retry it. If it is still unpaid after the retry period, we may move your account to the free plan or suspend paid features until it is paid. If you dispute a payment that was properly charged, we may suspend paid features while the dispute is resolved.
8.4 Price changes
We may change prices for a valid reason (for example changes in our costs, including the cost of AI models, or in taxes) with at least 30 days’ notice; changes apply from your next billing cycle after the notice period, and you can cancel before then without charge.
8.5 Taxes
Prices shown to consumers include any taxes we are required to charge. We are not currently registered for VAT, so no VAT is added; if that changes, we will show prices including VAT. Business users are responsible for any taxes they must account for themselves (for example under a reverse-charge rule).
9. Beta features and changes to the Service
9.1 Beta features
Features labelled beta, preview or experimental are early versions. They may change or be withdrawn at any time, may be subject to additional limits, and are excluded from any availability commitments. Use them with appropriate caution in production workflows. If you are a consumer and you pay for a beta feature, your statutory rights still apply to it.
9.2 Changes to the Service
We may change the Service for a valid reason: to comply with the law or a regulator’s guidance; to keep the Service and its users safe and secure; because an AI provider, integration partner or other supplier changes or withdraws what it provides; to fix problems; to prevent abuse; or to improve the Service. A change will not make you pay more for what you already have. If a change materially reduces the main features of a paid plan you are on, we will tell you at least 30 days in advance (unless the change is needed sooner for legal, safety or security reasons), and you may cancel and receive a pro-rata refund of any prepaid amount for the rest of the period. If you are a consumer in the EU, you may also end the contract free of charge within 30 days of a change that has more than a minor negative effect on you.
The free plan, free credits and trials are provided at our discretion and may be changed or ended at any time with reasonable notice.
10. Prompteryx Desktop and the Chrome extension
Prompteryx Desktop and our Chrome extension run automations on your own computer using your own browser. By installing them you agree to use them only with a valid Prompteryx account, to keep them reasonably up to date, and not to modify, decompile or reverse engineer them except where the law permits. Automations you run locally act with the access of your machine and browser profile — treat scheduled local automations with the same care as anything else that can act as you. Where desktop mode lets an AI model see and control your screen, anything visible may be sent to the AI provider you choose; close anything you do not want shared. Only install them from the Chrome Web Store or our own download page at prompteryx.ai/download.
11. API and SDK
If you use our REST API or SDK you must keep your API keys secret, stay within the rate and usage limits of your plan, and ensure anything you build on the API complies with these Terms. You are responsible for everything done with your API keys and for the applications you build and their users. We may change the API with reasonable notice (and without notice for security fixes), and we may throttle or suspend API access that degrades the Service for others.
12. Intellectual property
The Service — including its software, design, templates we author, documentation and branding — is owned by Prompteryx or its licensors and is protected by intellectual-property laws. Except for the rights expressly granted in these Terms, no rights in the Service are transferred to you. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service while your account is open. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you (this does not cover Your Content).
13. Suspension and termination
You may stop using the Service and delete your account at any time (Settings → Account, or by emailing contact@prompteryx.ai). Cancelling a paid plan is covered in section 8.3.
Suspension and termination by us for a reason. We may suspend or end your access, in whole or in part, straight away if: you seriously or repeatedly breach these Terms or the Acceptable Use Policy; we must do so to comply with the law, a court order or a regulator; your use creates a real risk of harm, security problems or legal liability for us, other users or third parties; you do not pay amounts that are due (section 8.3); or section 3.5 (sanctions) applies. Where practicable, and where the law allows, we will tell you why and give you a chance to fix the problem first; section 5.6 applies to decisions about Shared Content, and you can appeal under section 5.10.
Ending the contract on notice. We may also end these Terms with you for any other valid reason by giving at least 30 days’ notice; if we do, we refund any prepaid amount for the period after the end date and unused credit packs you paid for. We may close free accounts that have not been used for 24 months, after telling you at least 30 days in advance.
After termination you may request an export of Your Content within 30 days, after which we may delete it in line with our Privacy Policy. What happens to your Shared Content is set out in section 5.8. Ending the contract does not affect rights and remedies either of us already has. Sections that by their nature should survive termination (including 4, 5.3, 5.7, 5.8, 8, 12, 14, 15, 16, 19 and 20) survive.
14. Disclaimers
We provide the Service with reasonable care and skill. Beyond that, and beyond what these Terms expressly say, we do not promise that the Service will be uninterrupted or error-free, that automations will work on every website (sites change and deploy anti-automation measures), that AI output will be accurate, complete or suitable for your purpose, or that the Service will meet requirements you have not told us about.
If you are a business user, the Service is provided “as is” and “as available” and, to the fullest extent the law allows, all other warranties, conditions and terms (whether express or implied by statute, common law or otherwise, including as to satisfactory quality, fitness for a particular purpose and non-infringement) are excluded.
Content that other users share or publish, and content from third-party websites and services that appears in the Service (including live data that a user’s automation adds to a published page), is not created, checked or endorsed by us. We make no promise that it is accurate, lawful, safe or suitable, and you rely on it at your own risk. Labels, automated checks and moderation do not mean we have verified any content.
If you are a consumer, nothing in this section affects your statutory rights — for example, your right under the Consumer Rights Act 2015 to services provided with reasonable care and skill and to digital content that is of satisfactory quality, fit for purpose and as described.
15. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under your statutory rights as a consumer (for example under the Consumer Rights Act 2015).
15.1 If you are a business user
Subject to the paragraph above:
- we are not liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss of profits, revenue, business, contracts, goodwill or anticipated savings, for loss or corruption of data (except the cost of restoring it from our backups where we caused the loss), or for any indirect or consequential loss;
- we are not liable for loss caused by: third-party websites, services, AI models or integrations; content other users share or publish; automations, agents and instructions you configure or approve, or AI output you rely on without checking it; your failure to keep your credentials secure or to keep copies of your data; or events outside our reasonable control (section 17);
- our total liability arising out of or in connection with these Terms and the Service in any 12-month period is limited to the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the claim and (b) £100; and
- you must bring any claim within 12 months of becoming aware of the grounds for it.
These limits are reasonable given the price of the Service, the nature of AI and automation, and your ability to insure and to keep your own backups.
15.2 If you are a consumer
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if we and you knew it might happen when you started using the Service. We are not responsible for loss that is not foreseeable.
- We provide the Service for domestic and private use. If you use it for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
- If digital content we supply damages a device or digital content that belongs to you because we did not use reasonable care and skill, we will either repair the damage or pay you compensation, as the law requires.
- We are not responsible for loss caused by things outside our control (section 17), by third-party websites and services you choose to automate, or by actions you approved an agent to take after we showed you what it would do.
- Otherwise, our total liability to you in connection with the Service is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim and £100. This does not limit your right to the remedies the Consumer Rights Act 2015 gives you (for example a repeat performance or a price reduction) or to recover the price you paid.
16. Indemnity (business users)
If you use the Service in the course of business, you agree to indemnify us against claims, damages and reasonable costs arising from Your Content (including Shared Content you publish or share and apps you publish), your automations, your use of the Service in breach of the law (including data-protection, sanctions and consumer law), or your breach of these Terms — including claims by third parties whose websites, services, data or rights your automations or Shared Content affected, and claims by the users of apps and pages you publish — except to the extent the claim results from our own breach of these Terms or our negligence. We will tell you promptly about any such claim, let you take part in defending it, and not settle it without consulting you. This section does not apply to consumers.
17. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control — for example failures or outages of internet, cloud, AI-model or payment providers we depend on, cyber attacks we could not reasonably have prevented, power failures, acts of government or regulators, war, terrorism, civil unrest, natural disasters, epidemics or industrial action affecting third parties. If such an event affects the Service, we will tell you, take reasonable steps to limit its effect, and resume as soon as we can. If it stops a paid feature working for more than 30 days in a row, you may cancel and receive a pro-rata refund of any prepaid amount for the affected period.
18. Changes to these Terms
We may update these Terms from time to time for a valid reason — for example to reflect changes in the law or regulatory guidance, changes to the Service, or to protect users and the public. For material changes we will give notice (for example by email or an in-product notice) at least 30 days before they take effect if they are to your disadvantage (otherwise at least 14 days), and we may ask you to accept the new version when you next sign in. Where a change is required by law or a regulator, or is needed urgently to deal with a safety or security risk, it may take effect sooner; we will tell you about it as soon as reasonably possible. The “Last updated” date above always reflects the current version. If you do not agree to a change, you may cancel before it takes effect, and if you are on a paid plan we will refund any prepaid amount for the period after the change takes effect. We keep a record of the version you accepted; you can ask us for a copy.
19. Governing law, jurisdiction and disputes
Talk to us first. If you have a problem with the Service or these Terms, contact us at contact@prompteryx.ai. We will acknowledge your complaint, try to resolve it within 30 days, and tell you the outcome. We are not obliged to use an alternative dispute resolution (ADR) provider; if we cannot resolve a consumer complaint, we will tell you whether we agree to use one.
Business users. These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Service, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
Consumers. These Terms are governed by the laws of England and Wales. You can bring proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland you can also bring proceedings there. If you live in the European Union, you also keep the protection of the mandatory consumer laws of the country where you live and may bring proceedings in its courts. Nothing in these Terms requires you to use arbitration or prevents you from going to court.
20. General
- How the contract is made. The contract is made when you create your account and accept these Terms (by ticking the boxes at sign-up or accepting an update), or when you first buy a paid plan. You can review and correct what you entered before you submit it. The contract is in English. We keep a record of the version you accepted, and you can ask us for a copy at any time.
- Notices. We may send you notices by email to the address on your account or in the Service. You can send us notices at contact@prompteryx.ai.
- Transfer. We may transfer our rights and obligations under these Terms to another organisation (for example if our business is sold or reorganised); we will tell you, and if you are a consumer and unhappy with the transfer you may end the contract and receive a refund of any prepaid amount for the rest of the period. You may not transfer your rights or obligations without our written consent.
- No third-party rights. Nobody other than you and us has any right to enforce these Terms (Contracts (Rights of Third Parties) Act 1999), except that a person who reports content or appeals under section 5 may rely on the process described there.
- Severability. If a court decides that part of these Terms is invalid or unenforceable, the rest stays in force.
- No waiver. If we do not enforce a right straight away, we can still enforce it later.
- Entire agreement (business users). For business users, these Terms (with the documents they incorporate and any order form we sign) are the whole agreement about their subject matter and replace earlier arrangements; neither of us relies on any statement not set out in them. This does not limit liability for fraud or fraudulent misrepresentation.
- Order of precedence. If documents conflict, this order applies: a signed agreement with us; the Data Processing Agreement (for data protection); these Terms; the App Builder Terms; the Acceptable Use Policy.
